Terms of Use

These Terms of Use ("Terms") govern your access to and use of Journalia's AI-powered clinical documentation platform and related services ("Service"). By using the Service, you accept these Terms. If you do not agree to these Terms, you should not use the Service.

1. Service description

Journalia provides an AI-powered clinical documentation platform that helps healthcare professionals generate clinical notes from consultations. The Service includes:

  • Speech-to-Note: automatic generation of clinical notes from audio recordings of patient consultations
  • EHR integration: transfer of notes to electronic health record systems
  • Customisable templates: ability to configure note formats by specialty and preferences
  • SDK for integration: programming interface to integrate Journalia into third-party solutions

2. Eligibility

The Service is designed for authorised healthcare professionals and healthcare organisations in Europe. By using the Service, you confirm that:

  • You are an authorised healthcare professional or represent a healthcare organisation
  • You have the necessary permissions from your employer to use AI-based documentation tools
  • You will use the Service in compliance with applicable health personnel legislation and patient record regulations
  • You are at least 18 years of age

3. Account responsibilities

You are responsible for maintaining the security of your account and all activity that occurs under your account.

  • Keep your login credentials confidential and do not share them with others
  • Notify us immediately if you suspect unauthorised access to your account
  • You are responsible for reviewing and approving all AI-generated notes before clinical use
  • Ensure that content generated through the Service is professionally accurate before saving it to the patient record

4. Acceptable use

You agree to use the Service in a lawful and ethically responsible manner. The following is prohibited:

  • Using the Service for purposes unrelated to clinical documentation
  • Attempting to circumvent security measures or access controls
  • Reverse engineering, decompiling or attempting to derive the source code of the Service
  • Sharing access to the Service with unauthorised third parties
  • Using the Service in a manner that violates applicable health legislation or privacy regulations
  • Uploading or processing content that is illegal, offensive or infringing

5. Intellectual property

All intellectual property rights to the Service, including software, algorithms, design, trademarks and documentation, belong to Journalia AS. You are granted a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms. Clinical notes generated by the Service based on your consultations belong to you or your organisation. Journalia does not claim ownership of the clinical content.

6. Limitation of liability

The Service is a support tool for clinical documentation. AI-generated notes must always be reviewed and approved by qualified healthcare professionals before clinical use.

  • Journalia does not guarantee that AI-generated notes are completely error-free or clinically correct in all cases
  • Clinical responsibility for patient record content always lies with the treating healthcare professional
  • Journalia's total liability is limited to the amount you have paid for the Service in the preceding 12 months
  • Journalia is not liable for indirect losses, consequential damages or lost profits

7. Data processing

The processing of personal data through the Service is governed by our Privacy Policy. When your organisation is the data controller and Journalia acts as a data processor, the processing will be governed by a separate Data Processing Agreement (DPA). We process clinical data in compliance with the GDPR and applicable national privacy legislation, and the relevant requirements for processing health information.

8. Termination

You may terminate your use of the Service at any time by contacting us or through your account settings.

  • We may suspend or terminate your access for breach of these Terms
  • Upon termination, we will delete or return your data in accordance with our Privacy Policy and applicable legislation
  • Provisions that by their nature should survive termination (e.g. limitation of liability, intellectual property) will remain in effect

9. Governing law and disputes

These Terms are governed by Norwegian law. Any disputes arising from these Terms or the use of the Service shall first be attempted resolved through negotiation. If the parties cannot reach agreement, the dispute shall be settled by Norwegian courts with Oslo District Court as the legal venue.

10. Changes to the Terms

We reserve the right to modify these Terms. For material changes, we will notify you at least 30 days before the changes take effect via email or through the Service. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
